NOTICE OF TELEPHONIC MEETING

 

Pursuant to Section 418.016 of the Texas Government Code, on March 16, 2020, the Governor of the State of Texas granted the Office of the Attorney General's request for the temporary suspension of certain provisions of the Texas Open Meetings Act to allow for telephonic or videoconference meetings of governmental bodies that are accessible to the public in an effort to reduce in-person meetings that assemble large groups of people, as a precautionary measure to contain the spread of novel coronavirus COVID-19.

 

Accordingly, this Regular Session of the Board of Adjustment of the City of Bellaire, Texas, will be conducted telephonically in furtherance of this important and necessary objective to protect the public health and welfare in our community.

 

Members of the public will be entitled to participate and address the Board of Adjustment in the telephonic meeting, at the time for general comments and public hearing audience comments.  Any person desiring to address the Board must submit their request via e-mail to boa@bellairetx.gov.

 

The request must be received prior to the start of the meeting and include the speaker's full name and the phone number from which they will be calling in to participate in the meeting. The request must also indicate whether the speaker wishes to participate during the general public comment period, the public hearing comment period, or both. Speakers will be recognized during the comment period in the order their requests are received.

Docket # BOA-2021-01: A request by Alex Lopez of Frankel Building Group, on behalf of Bryan and Janet Pate, owners of the property at 4604 Oleander St., for an appeal of an administrative official’s determination in that the portion of the property next to the proposed porte cochere located at the front of the house does not meet the definition of a Side Yard as defined in Chapter 24, Article II, Section 24-202, Definitions, of the City of Bellaire Code of Ordinances, and therefore, a pool cannot be constructed in the front yard of the house. The property is located within the R-3 Residential Zoning District.
